Understanding the MMR Injury Claim Process

No‑fault program:

Congress created the National Vaccine Injury Compensation Program (VICP) in 1986 as a no‑fault alternative to traditional lawsuits to ensure a stable vaccine supply and provide a forum for vaccine‑injured people.

The goal was to make it easier to collect for injuries by not requiring the victim to prove that the vaccine maker was at fault.

Free legal representation:

Most claimants hire vaccine injury attorneys to prepare and file the petition. The Court generally awards reasonable attorneys’ fees and costs separately from any compensation, so it costs nothing for clients to pursue a claim.

Federal claims process:

Petitions are filed in the U.S. Court of Federal Claims. The Department of Justice represents HHS, and a special master decides whether to award compensation.

Types of compensation:

Awards can cover unreimbursed medical expenses, lost wages or earning capacity, pain and suffering (up to $250,000) and a death benefit.

Recognized MMR Vaccine Injuries

The Vaccine Injury Table maintained by HRSA lists conditions presumed to be caused by the MMR vaccine when the first symptom occurs within specific timeframes. Recognized injuries include:

Allergic Reaction
  • Anaphylaxis – severe allergic reaction within 4 hours of vaccination
  • Encephalopathy or encephalitis – brain inflammation 5–15 days after vaccination
  • Shoulder Injury Related to Vaccine Administration (SIRVA) – shoulder pain and limited range of motion within 48 hours of the shot
  • Vasovagal syncope – fainting within 1 hour of vaccination
  • Chronic arthritis – joint pain and swelling 7–42 days after vaccination
  • Thrombocytopenic purpura – decreased platelet count causing easy bruising 7–30 days after vaccination
  • Vaccine‑strain measles viral disease in immunodeficient recipients – onset when vaccine‑strain virus is identified or within 12 months if testing is inconclusive

If your condition is not listed, compensation is still possible if medical evidence shows the vaccine caused it, but the burden of proof is higher.
